Family Law Fixed Fee

After talking with your lawyer, you will receive a fixed fee quote for the work that needs to be done.

The fixed fee sets out the work agreed on and it includes all meetings, emails and telephone calls to get the job done. There is no hourly rate.

All work to obtain your Divorce Order:

  • Telephone / video conference with you to obtain all necessary information and documents.

  • Prepare your Divorce Application, sign it as your authorised witness and lodge it with the Court.

  • Prepare an Acknowledgement of Service.

  • Prepare and send a letter to your former partner to request they sign the Acknowledgement of Service.

  • Prepare an Affidavit of Service by post and sign it as your authorised witness.

  • File with the Court the Acknowledgement of Service and the Affidavit of Service by post.

  • If your former partner refuses to sign the Acknowledgement of Service:

    • Prepare and send a letter of instruction to a process server with an Affidavit of Service by Hand and copies of all Court documents for personal service.

    • Prepare an Affidavit Proving Signature and sign it as your authorised witness.

    • File with the Court the Affidavit of Service by Hand and the Affidavit Proving Signature.

  • Attend the Divorce Hearing on your behalf (if required by the Court)

  • Obtain the Divorce Order from the Court and send you a copy.

  • All communications with you, the Court, your former partner, and the process server to complete the steps above.

Fixed Fee Divorce Application

All work to complete your Financial Agreement:

  • Complete property title search and/or company search(es).

  • Letter to Superannuation Fund to notify of the proposed superannuation split.

  • Telephone/video conferences with you to obtain all necessary information.

  • Prepare the Financial Agreement, send a copy to your former partner’s lawyer.

  • All correspondence with your former partner’s lawyer to make any necessary changes to the Financial Agreement.

  • Provide you with written legal advice once no further changes are needed to the Financial Agreement.

  • Telephone/video appointment to discuss written advice.

  • Provide Certificate of Independent Legal Advice.

  • Arrange for signing of the Financial Agreement.

  • Certify the Financial Agreement.

  • Provide a Certified copy of the Financial Agreement to the Superannuation Fund.

  • All communications with you, your former partner’s lawyer and the Superannuation Fund to complete the above steps.

All work to complete your Application for Consent Orders:

  • Complete property title search(es) and/or company search(es).

  • Letter to Superannuation Fund to notify of the proposed superannuation split.

  • Obtain all necessary information from you and your former partner.

  • Draft the Application for Consent Orders and proposed Consent Orders.

  • Update and finalise the Application for Consent Orders and proposed Consent Orders.

  • Arrange for signing of the documents by electronic means.

  • Lodge your Application with the Court and respond to requests for further information (if any).

  • Obtain a final Court Order.

  • Certify the Court Order and provide it to the Superannuation Fund.

  • All communications with you, your former partner, the Superannuation Fund and the Court to complete the above steps.

All work to complete your property settlement negotiations:

  • Complete property title search(es) and/or company searches(es).

  • Letter to other side set out your instructions, request evidentiary documents and valuation report.

  • Request and review your evidentiary documents.

  • Review other side evidentiary documents and make further requests.

  • Exchange documents with other side.

  • Joint letter to engage agreed property valuer, review valuation report.

  • Letter of offer to other side (14 days to respond)

  • Advice on a counter-offer (if any).

  • Second letter of offer to other side (7 days to respond)

  • Advice on a second counter-offer (if any).

  • All communications with you, the other side and the valuer to complete the steps above.
